Boarding instructions on ships

This Boarding Instruction is the legal agreement between the person boarding the

Vessel (Visitor) and the Vessel. The Visitor’s access to and use of the Vessel is

subject to and governed by this Boarding Instruction.

By boarding the Vessel the Visitor acknowledges that he has read, understood, and

agrees to be bound by this Boarding Instruction. If the Visitor does not agree to this

Boarding Instruction he is not allowed to board the Vessel.

Definitions

1. In this Boarding Instruction the term “Owners” means the Shipowners

including Disponent Owners, Managers, Charterers, Master, Officers and

Crew of the Vessel.

2. The term “Visitor” includes the person boarding the Vessel, the company the

Visitor is employed with (“Company”) and, insofar as concerns disputes in

relation to loss of life, the dependants and/or legal representative of the

deceased.

Safety

1.) The Vessel is not a passenger ship and there is no warranty whatsoever that

the Vessel is fit for the carriage of passengers. Any undertaking as to

seaworthiness that might otherwise exist is hereby expressly waived.

2.) In case of General- and Fire-Alarm please follow the instructions of the Crew.

3.) The residence in the area of loading and / or discharging is forbidden for

unauthorized persons.

4.) In the area of loading and / or discharging operations the Visitor has to wear

safety clothing, such as but not limited to: safety helmet, safety shoes.

5.) Instructions and orders of the vessel’s Master, Officers and Crew have to be

obeyed at any time.

General

1.) The Visitor is permitted to embark (and remain) on board the Vessel, solely for

the purpose of executing his duties and obligations and for no other reason

whatsoever.

2.) The Master of the Vessel, may at his sole discretion and without any liability

on his, the Vessel’s and / or Owners’ part refuse remaining on board of the

Visitor, or any stage disembark the Visitor without being obliged to give any

reasons whatsoever.

3.) The Vessel and / or her Owners are not under the liability of a carrier towards

the Visitor. In particular, the Visitor expressly agrees to assume any and all

risks of loss of life, illness and personal injury, as well as loss of or damage to

personal effects or baggage or other property whilst onboard and whilst

embarking and disembarking. The Visitor expressly agrees that the Vessel

and / or Owners are not under liability whatsoever, whether statutory or

otherwise, and whether or not there be negligence on the part of any of the

aforesaid in respect of loss of life, illness, personal injury or loss of or damage

to personal effects, baggage or other property. The Visitor understands that

the vessel operates heavy machinery and cargo (being moved and/or

repaired) and has narrow and steep passageways and stairways and other

risk. The Visitor agrees to assume all of those risks and to release and hold

harmless the Vessel and / or Owners.

4.) The Visitor warrants compliance with all quarantine, passport and other

regulations and accepts responsibility for all other expenses, which may be

incurred by the Vessel and / or Owners due to the presence of the Visitor.

5.) The Visitor shall be permitted the use of parts of the Vessel’s space for which

he has express permission. The Visitor is not permitted to be in any other part

of the Vessel without the approval of the Master or his Officers.

6.) The Visitor and his luggage may be subject to security inspections, which may

involve physical search. The Visitor is not permitted to enter any restricted

area without express permission of the Master or his Officers.

7.) The Visitor warrants that he shall not bring on board contraband or illegal

substances such as but not limited to drugs and alcohol; nor firearms,

dangerous goods of whatever nature without prior written consent of Owners.

8.) The Visitor shall indemnify, hold harmless and defend the Vessel and / or

Owners against exposure to third parties for any damage, liability, suit, claim,

cost or expense (including but not limited to legal fees and costs), arising out

of any events or matters in connection with the Visitor occurring or not

occurring on board the Vessel; or which arises or relates out of Visitor’s

negligence or is caused by Visitor’s breach of this Boarding Instruction; or

results from any international or negligent act or omission of the Visitor.

9.) If any term or provision in this Boarding Instruction shall in whole or in part be

held to any extent to be illegal or unenforceable under any enactment or rule

of law that term or provision or part shall to that extent be deemed not to form

part of this Boarding Instruction and the enforceability of the remainder of this

Boarding Instruction shall not be affected.

10.) For sake of clarification, all headings given in this Boarding Instruction shall

not form part of this Boarding Instruction but are for convenience only; the

singular includes the plural and vice versa, the masculine includes the

feminine and vice versa.
